ACCESS AGREEMENT/DISCLAIMER

You must agree to this “SIH MyChart Patient Portal Access Agreement/Disclaimer” (the “Agreement”) before you use the SIH MyChart patient portal.

The terms of the Agreement are:

  1. This Agreement constitutes a binding agreement between the user (“you”) and Southern Illinois Hospital Services, Southern Illinois Healthcare Medical Group, its physicians, employees, contractors, affiliates, subsidiaries, owners, officers and directors, and agents (together hereinafter “SIH”).
  2. By signing this Agreement you acknowledge that you are at least 18 years of age, or legally emancipated, and that you are requesting access to portions of your personal health information and the ability to communicate with your SIH health care team via the internet using an electronic application called the MyChart patient portal. You acknowledge that the MyChart patient portal is offered as a courtesy to SIH’s patients in order to allow you to view your personal medical information and/or to send private messages to and from your health care provider and agree that SIH may limit or discontinue your use of the MyChart Portal at any time for any reason.

By signing this Agreement where indicated below you agree to the following rules for utilizing MyChart patient portal from SIH.

  1. MyChart patient portal is NOT to be used for urgent or emergency medical care situations. In the event of a medical emergency you will call for local 911 services, or go directly to the emergency room.
  2. MyChart patient portal will contain health information about you that is maintained by SIH. The information may include but is not limited to: billing and account statements, prescription drug information, secured email transmissions between myself and SIH, clinical testing, including but not limited to, genetic testing information, mental health treatment information (excluding psychotherapy notes), infection disease information (including sexually transmitted disease, AIDS/HIV), reproductive information,  medical research records of both open and closed trials, mental, physical or sexual abuse information, and substance abuse information.  SIH, may, within its discretion withhold from disclosure any of the above information.
    • I understand that the disclosure of HIV/AIDS-related records and information could have adverse consequences for me, including the loss or denial of employment, the loss or denial of health or life insurance benefits, alienation from friends and family members, and other forms of discriminatory treatment, whether lawful or unlawful.
    • I understand that I have the right to review my mental health records at any reasonable time prior to authorizing their disclosure.
    • I understand that my authorization includes the authorization to disclose any information or records (within the scope of the authorization) that SIH Physicians has received from other healthcare providers or facilities.
    • The purpose of this authorization is to enable MyChart patient portal to maintain my personal health record on my behalf, subject to my control and direction.
  3. It may take up to 24 business hours to receive a response to an email request that you send. You understand that IF you do NOT receive a response within 24 business hours you will contact your SIH provider.
  4. The individual MyChart patient portal username and password you choose when you first login to MyChart patient portal are the keys to protecting the confidentiality of your information. You are responsible for remembering your MyChart patient portal username and password and for keeping them confidential. Anyone with access to my MyChart patient portal username and password will be able to view your personal medical information and communicate with your health care team as if that person were you. It is your responsibility to prevent disclosure of your username and password and change your password if I feel that your security has been compromised. You can change your password online at any time. You are solely responsible for any sharing of SIH content that you intentionally or unintentionally communicate to others.
  5. You may request a MyChart patient portal account for yourself and/or any other person who has given you written authority (a “Proxy”). By accepting these Terms and Conditions, you certify that you are authorized to open or access the account you are requesting and that all information you have provided to SIH is true and correct to the best of your knowledge. You further agree that in the event you request a MyChart patient portal account or information on behalf of a Proxy you may be required to provide documentation of your authority (for example, a durable healthcare power of attorney) before you can receive an access code to complete registration or access that person’s health information. If you have given another individual proxy rights to your MyChart patient portal, and your relationship with the proxy terminates (e.g., divorce, separation) it is your responsibility to remove this individual’s proxy rights in my MyChart patient portal.
  6. Once you have activated your MyChart patient portal account, MyChart patient portal may be used to receive important messages from your participating SIH provider(s). YOU MUST provide SIH with your email address when activating your MyChart patient portal account and keep your email address current to ensure that you receive notification of newly released information in a timely manner.
  7. All communications between you and your SIH health care team using MyChart patient portal are carried over a secure, encrypted connection directly into the SIH electronic medical record. While you may receive Internet e-mail messages notifying you of new messages in your MyChart patient portal Inbox, these e-mails will not contain any personal health information. It is your responsibility to login to your MyChart patient portal account and read the messages promptly.
  8. Providers and staff at SIH may use MyChart Patient portal to communicate lab and other test results to you, and you accept this method of communication.
  9. You understand that you should remember to log out and close your internet browser each time you are finished accessing password-protected MyChart Patient portal services. This will prevent someone else from accessing your personal medical information if you leave, share, or use a public computer or unsecured wireless network: e.g.; internet café, library, kiosk, etc.
  10. You understand that routine laboratory and diagnostic test results may be available on MyChart patient portal prior to being reviewed by your provider. You understand that these test results can potentially be confusing to someone without medical knowledge and thus require interpretation by a medically trained professional.
  11. You understand that it may take up to 7 business days for interpretation to be complete once it is available in your electronic chart.
  12. While SIH uses state-of-the-art security, no system can guard against risks of intentional intrusion or inadvertent disclosure of information. When using MyChart patient portal, information will be transmitted over a medium that is beyond the control of SIH and its contractors. You HEREBY EXPRESSLY ASSUME THE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION, OR OF ANY DELAY, FAILURE, INTERRUPTION OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH THE USE OF THIS SERVICE. Once information is received by SIH, your medical information will be treated as confidential and given the same protection that all other SIH medical records receive.
  13. By using the MyChart patient portal, you acknowledge and agree that use of MyChart patient portal is intended to facilitate dialogue and information regarding personal health matters. You agree not to use MyChart patient portal to send or post any illicit or offensive material, harass or exploit the services provided in MyChart. You understand that in doing so SIH has the right to deactivate your MyChart patient portal account.
  14. Messages will be routed to the appropriate department as necessary for handling, and therefore SIH employees, other than your healthcare provider (physician, nurse practitioner and/or physician’s assistant), may be involved in addressing your request. If your provider is out of the office or unavailable to respond, messages sent via the MyChart patient portal may be routed to other authorized healthcare providers within SIH to facilitate a timely response to your request. Therefore use of the MyChart patient portal may not be appropriate if there is sensitive information that you want to discuss directly with your healthcare provider.
  15. The SIH health care team may send you messages, test results, and other communications via the MyChart Patient portal as authorized in the sole discretion of your physician. These messages may contain information important to your health and medical care. It is your responsibility to monitor these messages. By providing your valid and functional e-mail address, you have authorized SIH to notify you of messages sent to your MyChart Patient portal Inbox.
  16. SIH is not liable for any loss, injury, illness, damages or claims of any kind resulting from your failure to timely read messages you may receive through the MyChart patient portal.
  17. You may discontinue your use of the MyChart patient portal at any time by contacting SIH Portal Liaison.
  18. SIH reserves the right, in its sole discretion, to limit or discontinue your use of MyChart patient portal at any time and for any reason, including but not limited to your use of the MyChart Patient portal on behalf of another person. You will be notified if your MyChart Patient portal service is discontinued.
  19. SIH is required to maintain documentation of your medical history, current conditions, treatment plan and all treatments given, including the results of all tests, procedures and therapies. The MyChart Patient portal is an Internet application that enables a patient to have secured Web-based access to personal clinical information, as released by the SIH health care team, and allows secure electronic messaging with participating SIH providers. By using the MyChart patient portal, you understand that not all of your SIH medical record will be accessible through your MyChart patient portal account. Posting of information to your MyChart patient portal account is at the sole discretion of your individual provider(s) or determined by policy.
  20. Messages you send or receive via the MyChart patient portal may become part of your permanent medical record at the sole discretion of SIH. If such messages are made part of your permanent medical record, they will be accessible to current and future SIH staff members who are involved with your care.
  21. All SIH-generated electronic medical records are subject to state and federal regulations governing the security and confidentiality of medical records. All content included in the MyChart patient portal and on all SIH web sites, including, but not limited to, text, photographs, graphics, button icons, images, artwork, names, logos, trademarks, service marks and data ("Content"), in any form are protected by U.S. and international copyright law and conventions. The Content includes both Content owned or controlled by SIH, its subsidiaries or affiliates as well as Content owned or controlled by third parties and licensed to SIH. Reproduction of any Content, in whole or in part, by any means, is prohibited without the express written consent of SIH.
  22. Your access to the MyChart patient portal may be audited.
  23. This Web site and the MyChart patient portal may contain links to Web sites operated by other parties which might have information on health topics of interest to me. Any such links are provided for your general information and education only, and should NOT be relied upon for personal diagnosis or treatment. SIH does not sponsor or endorse any of these sites, nor does SIH make any guarantee, warranty or representation regarding the accuracy of the information contained on the Web sites. SIH has no control over the security or privacy practices of these external Web sites. Use of other sites is strictly at your own risk including, but not limited to, any risks associated with destructive viruses. You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of the other Web sites.
  24. The terms and conditions of this disclaimer and user Agreement may change periodically. Such modifications will take effect immediately upon posting to the SIH website. You understand that you should review this Agreement routinely for changes and modifications.
  25. You hereby agree to indemnify, defend, and hold harmless SIH its physicians, employees, contractors, affiliates, subsidiaries, owners, officers and directors, and agents from and against all actions, claims, suits, demands, damages, judgments, losses and any other costs, liabilities and expenses, including reasonable attorney’s fees and collections cost arising from any act, error, or omissions of SIH and the provision of or failure to provide any of the services within the scope of the MyChart patient portal duties as outlined in the Agreement, included but not limited to, advisory and consulting services.
  26. You understand that this Agreement is, and by express agreement between the parties, by Illinois State law. By using SIH’s website including but not limited to the MyChart patient portal, you agree that the laws of the state of Illinois, without regard to principles of conflict of laws, will govern the interpretation of this Agreement and any dispute that might arise between you and SIH.. You expressly agree that exclusive jurisdiction for any dispute with SIH resides in the courts of Illinois State and you further agree and expressly consent to the exercise of personal jurisdiction in the state and federal courts located in Jackson County, Illinois in connection with any claim involving SIH. Use of SIH’s Web site is unauthorized in any jurisdiction that does not give effect to the terms and conditions set forth herein.
  27. Failure to comply with any of the terms and conditions contained in this Agreement may result in revocation of your license and cancellation of your MyChart patient portal account including the right to access information through MyChart patient portal on behalf of any proxies. SIH reserves the right to report violations of law to appropriate law enforcement agencies and to pursue all other rights and remedies available to it under civil or criminal law.

By signing the Agreement you understand and agree to all the terms and conditions in the Agreement. The invalidity of any provision(s) or portions of the provision(s) of this Agreement shall not affect any other provision(s) or portions thereof.  In the event that one or more provisions (or portions thereof) of this Agreement are declared legally invalid, the remainder of this Agreement shall remain in force and affect.  Changes in the law affecting this Agreement shall be deemed incorporated upon their effective date.  You understand that the availability and functionality of the MyChart patient portal may change without prior notice. You agree not to hold SIH, or its physicians, employees, contractors, affiliates, subsidiaries, owners, officers and directors, and agents liable for any unanswered MyChart Patient portal messages or requests.

USE OF THIRD PARTY SERVICES

You may choose to use other services provided by third parties in conjunction with your use of MyChart. Such services may include, but are not limited to, translation services, location services, and other third-party offerings. Any links to such services are provided for your convenience only. Neither Epic nor SIH have control over the contents of these services, and neither Epic nor SIH accept any responsibility for them or for any loss or damage that may arise from your use of them. Such services may require you to submit your information to a third party, which may result in a copy of your information being used and/or stored by a third party. If you decide to access any such services in conjunction with your use of MyChart, you do so entirely at your own risk and subject to the terms and conditions of use for such services.
